1. Copyright Complaints
MSPClouds respects intellectual-property rights and responds to notices that satisfy the Digital Millennium Copyright Act, 17 U.S.C. § 512. A notice should identify the copyrighted work, identify the allegedly infringing material and its location on MSPClouds infrastructure, provide the complaining party’s contact information, include the required good-faith and accuracy statements, and contain the physical or electronic signature of an authorized person.
2. Forwarding and Action
Where appropriate, MSPClouds may forward a complaint to the affected customer, request additional information, disable access to identified material, or take other action consistent with law and the Agreement. A complaint does not automatically establish infringement.
3. Counter-Notification
A customer whose material was removed or disabled may submit a counter-notification that satisfies 17 U.S.C. § 512(g), including identification of the removed material, a statement under penalty of perjury regarding mistake or misidentification, contact information, consent to the applicable federal court jurisdiction, acceptance of service, and a signature.
4. Repeat Infringers
In appropriate circumstances, MSPClouds may terminate accounts of repeat infringers. MSPClouds may consider the nature, frequency, reliability, and disposition of notices and counter-notices when applying this policy.
5. Designated Agent
Before publication, MSPClouds should confirm and publish the exact name, mailing address, telephone number, and email address of its registered DMCA designated agent and ensure the same information is current in the U.S. Copyright Office directory. Until that information is confirmed, this draft must not be represented as the final statutory notice address.
