1. Scope and Roles
This Privacy Policy explains how MSPClouds collects and uses personal information when you visit our websites, request information, create or administer an account, communicate with us, receive support, or otherwise interact with MSPClouds. It does not govern personal data contained in workloads that customers submit to the Services for processing on their behalf; that processing is governed by the customer Agreement and DPA.
2. Information We Collect
We may collect identifiers and business contact details; account and authentication data; billing and transaction information; support communications; sales and migration information; device, browser, IP address, log, security, and usage data; cookie and preference data; and information you voluntarily provide. We do not intentionally require special-category data for ordinary website or account use.
3. Sources
We collect information directly from you, automatically from your device and use of our Services, from your organization and authorized users, from service providers, and from lawful business sources such as referral partners or public business information.
4. Purposes and Legal Bases
We use personal information to provide and secure Services; create and administer accounts; process transactions; respond to support and migration requests; prevent fraud and abuse; maintain infrastructure; comply with law; improve products; communicate service information; and market to business contacts where permitted. For EEA/UK individuals, our legal bases may include performance of a contract, legitimate interests, compliance with legal obligations, and consent where required.
5. Cookies and Similar Technologies
We may use strictly necessary cookies for security, sessions, load balancing, preferences, and forms. Analytics or advertising cookies, if deployed, should be activated for EEA/UK visitors only after the legally required consent. Visitors can withdraw consent through the cookie-preference control. Browser settings may also limit cookies, although necessary functions may be affected.
6. How We Share Information
We may share information with infrastructure, security, communications, payment, analytics, professional, and support providers; affiliates; transaction counterparties in a corporate transaction; authorities when legally required; and others at your direction. We do not sell personal information for money. If we ever engage in activity legally defined as “sale,” “sharing,” or targeted advertising, we will provide required notices and opt-out mechanisms.
7. Customer Workload Data
Customer controls the data it places in hosted workloads. MSPClouds processes such data only to provide, secure, support, and maintain the Services, as instructed by Customer, as otherwise permitted by the Agreement/DPA, or as required by law. Customers are responsible for their own privacy notices, legal bases, end-user requests, and data minimization.
8. International Transfers
MSPClouds is based in the United States and may process information in the United States and other countries where MSPClouds or approved providers operate. Where European data-protection law requires a transfer mechanism, the DPA may incorporate the European Commission Standard Contractual Clauses and, for UK transfers, the applicable UK transfer addendum or other lawful mechanism. Supplementary measures may be used where appropriate.
9. EEA, UK, and Swiss Rights
Subject to applicable law, individuals may have rights to access, correct, erase, restrict, object to processing, receive portable data, withdraw consent, and complain to a supervisory authority. Objections to direct marketing will be honored. Rights are not absolute and may be limited by legal exceptions. We may verify identity and authority before fulfilling a request.
10. U.S. State Privacy Rights
Residents of certain U.S. states may have rights to know/access, correct, delete, obtain a portable copy, and opt out of certain sale, sharing, targeted advertising, or profiling activities, subject to exceptions. We will not unlawfully discriminate for exercising applicable rights. Authorized agents may submit requests where permitted and properly verified.
11. Retention
We retain personal information for as long as reasonably necessary for the purposes described, including the duration of the business relationship, security and backup cycles, dispute periods, tax/accounting obligations, and legal requirements. Retention varies by data type and context. Customer workload data is handled under the Agreement and DPA.
12. Security
We use commercially reasonable safeguards designed to protect personal information, including access controls, network and system protections, logging, and administrative measures appropriate to the context. No Internet transmission or storage system is guaranteed to be completely secure.
13. Children
The Services are business services and are not directed to children. We do not knowingly collect personal information from children through the website for consumer purposes. Customers are responsible for ensuring lawful processing if their own workloads involve minors.
14. Automated Decision-Making
MSPClouds does not currently make decisions producing legal or similarly significant effects about website visitors solely through automated processing. If that changes, we will provide notices and rights required by applicable law.
15. Data Protection Requests and Complaints
Requests may be submitted to privacy@mspcloud.io or by contacting MSPClouds at the address listed below. We may request information needed to verify identity. EEA/UK/Swiss individuals may also complain to their local supervisory authority.
16. Changes and Contact
We may update this Policy as practices or laws change. Material changes will be identified by an updated effective date and additional notice where required. Contact: MSPClouds, 1100 White St SW Suite 215, Atlanta, Georgia 30310, United States; privacy@mspcloud.io; +1-800-659-9875.
